Casino thinks KSA’s biggest sanction ever is ridiculous
Videoslots will challenge the Kansspelautoriteit’s largest fine (KSA) in its history after accusing the Dutch regulator with abusing the mystery-shopping regime.
The logo of the regulator was incorrectly displayed on Videoslots’ website in preparation for a KSa request in April 2022. It was quickly removed.
The KSA was alerted to the error and attempted to register as a Dutch customer. However, the effective security measures prevented the KSA from succeeding. KSA was able to gain unauthorised access by pretending that it was a German customer and managed to deposit a sum of $20.
Videoslots was alerted by the KSA that an official had illegally accessed its website and took further steps to stop this from happening again.
After claiming Videoslots had violated the Dutch Gaming Act, the KSA has issued a EUR9,874,000 fine. This will be its largest ever sanction. Videoslots denied the allegations and objected to the fine.
Ulle Skottling (Deputy CEO at Videoslots) stated that Videoslots doesn’t target or restrict the Netherlands and therefore the Dutch Gaming Act is not applicable to its services. Our site was not accessible to Dutch players during the dispute period, and there was no violation.
“It is absurd for the KSA to fine us after we have gained unauthorised access. It is impossible to fully protect against unauthorised access and the KSA does not have sufficient guidelines.
“Furthermore there was no evidence of damage and the interests Dutch consumers were not compromised at any time. Based on multiple guesstimates, the KSA determined that the fine was appropriate. It has no basis and there is no sense of proportionality.
Videoslots is very serious about its regulatory and legal obligations. However, we disagree with the KSA’s conclusions and actions, which we consider illegal. We expect a positive outcome in the case.
